Terms & Conditions of Sale

1. Application
These Terms govern the sale by General Stores Online to you of Products for which you place an order that is accepted by General Stores Online. No other terms and conditions shall apply. Your acceptance of the Products shall be deemed to constitute acceptance of these Terms.

2. Orders
All orders placed by you are subject to acceptance by General Stores Online. General Stores Online reserves the right to revise prices, limit quantities, correct errors in its catalogue or on its website and refuse orders at its discretion including, without limitation, orders from distributors, dealers and warehouse stores. Except as may otherwise be permitted by applicable law, you may not cancel an order accepted by General Stores Online without the agreement in writing of General Stores Online, a requirement which may be waived by General Stores Online from time to time at its sole discretion.

3. Delivery
Our normal delivery times are 3-10 working days. Working days are defined as Monday to Friday, excluding public holidays. Some goods may be delivered before or after this time according to our dispatch rota and/or stock status. Please see the Availability Notice in the item description. Some items are not held in stock and will be ordered in when you buy. Some items for sale on the website may not be available from our supplier in this case. Please check before you buy by calling us on 01225 819 991. Goods to be delivered to most UK mainland addresses will be sent via a third party courier offering next day delivery, or Royal Mail 1st class Recorded Service. Next day delivery is not offered to the following postcodes: FK17-22 G83 IV1-28 IV33-39 KW1-3 KW5-14 PA21-33 PA35-40 PH18-26 PH30-42 HS1-9 IV40-51 IV55-56 KA27 KA28 KW15-17 PA20 PA34 PA41-48 PA60-78 PH42-44 ZE1-3 and all EL post codes. Deliveries to these areas may typically take 72 hours.

Delivery to addresses that are not on the UK mainland, for example those located within the GY or JE post code areas, may be subject to an additional fee. Next day delivery is not possible to addresses outside the UK mainland. We also cannot deliver to Switzerland, Norway, Greece, Turkey and all of the former Eastern Europe. Please note that oversized or bulky items may require additional delivery times. General Stores Online shall endeavour to inform you of extended delivery times at the time you place your order.

General Stores Online shall not be liable for any cost or damage caused by late or non-delivery of any products. Once items have been dispatched by General Stores Online, any delay in delivery shall not give you the right to reject goods or cancel your order. General Stores Online reserves the right to deliver goods in instalments.

All goods should be paid for at the time an order is placed. General Stores Online reserves the right, by giving notice at the time an order is placed, to increase the price of goods to reflect any increase in the cost to General Stores Online which is due to any factor beyond its control.

5. Warranty and Returns Policy
As an internet provider of goods to the public, we are bound in the UK by the Consumer Protection (Distance Selling) Regulations 2000, the E-Commerce Regulations 2002, and the Sale of Goods Act 1979-2002. We are a professional company and undertake to adhere to these regulations. Please note however that these regulations apply differently in relation to business to business transactions, please see our Liability statement below.

Subject to the limitations on its liability set out in these Terms, General Stores Online warrants that items be free from defects in material and workmanship for a period of one year from the date of delivery.

General Stores Online shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions or misuse.

If you notify General Stores Online of a valid claim under the terms of this warranty, within a period of one year, General Stores Online will replace or repair the item or refund the original purchase price of the item, at our discretion. In the case of faulty or damaged goods, you must return the goods to us. We will then refund your postage costs on top of any other repair or replacement. If you receive the item and wish to return it for any reason other than damage or fault, you must notify us within seven working days of receipt, by a written medium such as email or letter. You then have a reasonable time to send it back to us. If we are not notified within the statutory period then refund cannot be given. When returned, the item must be unused, boxed, and suitable for resale as new. We will refund the item price within 30 days of receipt. In this case all postage costs must be borne by the buyer. General Stores Online shall have no other liability to you. 6. Liability
Nothing in these Terms shall exclude or limit General Stores Online's liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may not be excluded or limited as a matter of law. Without prejudice to the previous sentence, General Stores Online shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of General Stores Online, its breach or non-performance or any of its obligations under these Terms or otherwise. These Terms set out the full extent of General Stores Online' obligations and liabilities in respect of the sale of the Products. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose or of any other kind whatsoever, that are binding on General Stores Online except as specifically stated in these Terms. Any condition, warranty or other term concerning the sale of the Products, which might otherwise be implied into or incorporated within these Terms, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law. If you are a consumer the exclusion of terms implied by law will not apply to you.

7. Data Protection
The personal information you provide to General Stores Online consists of your name, your postal and e-mail addresses, other contact details as well as order, delivery and billing information; it will be maintained as part of our customer records for the purposes of credit checking, direct marketing, orders delivery and product purchase history. You may also receive news and marketing offers from other General Stores Online companies.
You can contact General Stores Online at General Stores Online, 17 Fiveways House, Fiveways Industrial Estate, West Wells Road, Corsham, Wiltshire, SN13 9RG during normal working hours to see the information held about you and to ask us to remove or correct it.
By entering into any agreement with General Stores Online or providing General Stores Online with personal data, you consent to the processing and transfer of such data in the manner and for the purposes described here above.
General Stores Online shall not be liable to you for any loss or damage you might suffer arising from General Stores Online's delay in fulfilling, or failure to fulfil, any of its obligations under these Terms, to the extent that such delay or failure is caused by any circumstance beyond General Stores Online's reasonable control. If due to such circumstances or events General Stores Online has insufficient stocks to meet all its orders, General Stores Online may apportion available stocks between its customers at its sole discretion. These Terms and any terms appearing on any order form to which these Terms apply constitute the entire agreement between you and General Stores Online relating to the Products. The failure of General Stores Online or you to enforce any of these Terms does not constitute a waiver of that term and shall in no way affect the right later to enforce the term. The invalidity or unenforceability of any clause of these Terms shall not adversely affect the validity or enforceability of the remaining provisions. No amendment, variation or addition to these Terms shall be binding unless agreed to in writing by an authorised representative of General Stores Online. General Stores Online may transfer any contract with you concluded on these Terms or any of its rights or obligations under any such contract. These Terms will be construed in accordance with the laws of England and any disputes shall be settled by the English courts.
